ABSTRACT:


The article targets a historiographical analysis of the establishment of probation in Romania and the Republic of Moldova as a system of social alternatives to the incarceration of persons who have committed crimes. The evolution of probation lies in the institutional perspective on an ascending track, so both countries seems to understand, at least at the level of public policies, the need for alternatives to the non-custodial punishment. The penal reform has included probation as central social institution in the system of recovery of people who have committed crimes.
